 OSHA Federal / State Plans Overview

  • Each state has the right to “opt-out” of Federal OSHA, but the state plan MUST at least promulgate rules and statues that are equivalent to Federal Standards.
  • District Seven has Seven (7) states that have state run OSHA plans; Alaska, Arizona, Iowa, Minnesota, New Mexico, Oregon, Utah, and Washington, https://www.osha.gov/dcsp/osp/
  • The other states are Federal OSHA plans.; Colorado, Idaho, Iowa, Nebraska, North Dakota, South Dakota, and Wyoming

District Seven OSHA Plans:

  • State plan MUST at least promulgate rules and statues that are equivalent to Federal Standards.
  • State plan can exceed the Federal Standards;
  • Minnesota, Oregon, and Washington state OSHA plans exceed the Federal Standards in several areas.
  • Examples of a state plan that exceeds the Federal Standard:
  • Minnesota requires the Union to “sign-off” on final settlement agreement (Lead Exposure Case)
  • Minnesota requires if a Company requires Personal Protective Equipment (PPE); the Company must bargain with the Union on an PPE allowance; Federal statures exempts safety boots from reimbursement.
  • Minnesota, Oregon, and Washington state run plans are appropriately funded and Staff for enforcement
  • Washington mandates monthly joint safety meeting that are required to have written minutes
